1. Who we are and who can use Syncogia
Syncogia (“we”, “us”) provides the Syncogia app and website.
You must be at least 13 years old, and old enough to enter a binding agreement where you live, or have a parent’s or guardian’s permission. Give us accurate information, keep your sign-in details private, and tell us if you suspect someone else is using your account. You are responsible for activity on your account.
2. Your content
You keep ownership of the decks, cards, comments, images, audio, and other content you add (“Your Content”). You give us a worldwide, non-exclusive license to host, store, copy, display, and transmit Your Content only as needed to run and improve Syncogia. If you make a deck public or share it, you also allow other users to view it, study it, and, where the app allows, copy or collaborate on it.
You are responsible for Your Content. Only add content you have the right to use. Do not add personal information about other people without their permission.
3. Acceptable use
Do not use Syncogia to:
- post content that is illegal, hateful, harassing, sexually explicit, violent, or that exploits or endangers children;
- infringe someone’s copyright or other rights, or share material you do not have permission to share;
- impersonate others, spam, or mislead people;
- probe, scrape, overload, or bypass the security of the app or our servers, or access accounts that are not yours;
- use bots or automated means to create accounts or content in bulk.
4. Reporting and moderation
You can block other users. To report a deck, a comment, or a user, use the Report option in the app. You can also email support@syncogia.com. Content that receives enough reports from established accounts may be hidden until we have reviewed it. We may remove content, limit features, or suspend or close accounts that break these terms or put others at risk, and we try to act on reports promptly. If we act on your content and you think we got it wrong, write to support@syncogia.com and we will look again.
Copyright complaints
We respect intellectual property rights. If you believe content on Syncogia infringes your copyright, email our designated copyright contact at support@syncogia.com with the subject “Copyright notice” and include: (a) your physical or electronic signature; (b) a description of the copyrighted work; (c) where the material is in Syncogia (for example a deck link) so we can find it; (d) your contact details; (e) a statement that you believe in good faith the use is not authorized by the owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner.
We may remove or disable access to the material and tell the person who posted it. If you posted content that was removed and you believe it was a mistake, you may send us a counter-notice with your signature, a description of the removed material and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification, your contact details, and your consent to the jurisdiction of the courts where you live. We may restore the material if the complainant does not tell us within 10 business days that it has started legal action. We close the accounts of users who repeatedly infringe copyright.
5. Content from other users
Decks, comments, and other content are created by users, not by us. We do not verify or endorse it, and we are not responsible for its accuracy or for what other users say or do. Check important facts against a reliable source.
6. Social features
Public decks, comments, and shared decks involve other people. What you share there can be seen by them, depending on the choices you make. When you invite someone to a deck, you decide whether they can add and edit cards (Editor) or only view and study them (Viewer).
7. Learning results
Syncogia’s schedules are based on a statistical model of memory. They help you study efficiently but do not guarantee any result, such as an exam score.
8. Our service and intellectual property
Syncogia, its design, software, and branding belong to us and our licensors. We give you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, subject to the Apple Media Services Terms and the Apple Licensed Application End User License Agreement. Do not copy, modify, reverse engineer, or resell the app except as the law allows.
9. Ending your account
You can stop using Syncogia at any time and delete your account in the app. See how to delete your account. We may suspend or terminate your access if you break these terms or if we must by law. What happens to your data afterwards is described in the Privacy Policy.
10. Changes to the service and these terms
We may change or discontinue features, and we may update these terms. We will change the date above and, for significant changes, tell you in the app or by email. If you keep using Syncogia after a change takes effect, you accept the new terms.
11. Disclaimer
Syncogia is provided “as is” and “as available”. To the extent the law allows, we do not promise that it will be uninterrupted or error-free, or that data will never be lost. Keep your own copy of anything important.
12. Limit of liability
To the extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill, arising from your use of Syncogia, including damages caused by content that other users post, by outages, or by third-party services. Syncogia is free, and to the extent the law allows, our total liability to you for any claim related to the app is limited to the amount you paid us for the app in the twelve months before the claim, which is zero if you paid nothing. Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury, intent, or gross negligence, or your statutory consumer rights.
Your responsibility for Your Content
To the extent the law allows, you agree to defend and compensate us, and our owners and contributors, for claims, damages, and reasonable legal costs that arise from Your Content, your breach of these terms, or your violation of the law or of another person’s rights.
Feedback
If you send us ideas or suggestions, we may use them freely, without payment or credit to you, and you give us a worldwide, perpetual, royalty-free license to do so.
Export and sanctions
You may not use Syncogia if you are in, or ordinarily resident in, a country or region under a comprehensive embargo, or if you are on a government list of prohibited parties. You must follow the laws that apply to your use of the app and of any third-party services you use with it.
13. Apple
These terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the app, and is not responsible for claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Governing law
These terms are governed by the law that applies to you as a consumer where you live, to the extent that law requires it, and otherwise by the law that applies to us. Nothing here limits mandatory consumer rights.
